Protection of Personal Data

1. Purpose

As empharmailac.com, our priority is to ensure that the personal data of natural persons, including our members, customers, visitors, suppliers and employees, are processed in compliance with the applicable legislation, in particular the Constitution of the Republic of Türkiye, the international conventions on human rights to which our country is a party and Law No. 6698 on the Protection of Personal Data (“KVKK”), and that the data subjects whose data are processed can exercise their rights effectively.

For this reason, we carry out the processing, storage and transfer of all personal data we obtain in the course of our activities, including but not limited to those of our employees, suppliers, customers, visitors, members and the users who visit our stores, website and mobile applications, in accordance with the empharmailac.com Personal Data Protection and Processing Policy (the “Policy”).

The protection of personal data and the observance of the fundamental rights and freedoms of the natural persons whose personal data are collected is the basic principle of our policy on the processing of personal data. For this reason, we carry out all our activities in which personal data are processed with due regard for the protection of the privacy of private life, the confidentiality of personal information, the confidentiality of communication, freedom of thought and belief, and the right to use effective legal remedies.

For the purpose of protecting personal data, we take all administrative and technical protection measures required by the nature of the relevant data, in line with the legislation and current technology.

This Policy explains the methods we follow for the processing, storage, transfer and deletion or anonymization of personal data shared during our commercial, promotional and marketing, social responsibility and similar activities, within the framework of the principles set out in the Law on the Protection of Personal Data.

2. Scope

All personal data processed by the Company, including those of our visitors, business contacts, business partners, employees, suppliers, members and third parties, fall within the scope of this Policy. Our Policy applies to all personal data processing activities owned or managed by the Company, and has been drawn up and prepared with due regard for the KVKK, other relevant legislation on personal data and the international standards in this field.

3. Definitions and Abbreviations

This section briefly explains the special terms and expressions, concepts, abbreviations and the like used in the Policy.

  • empharmailac.com: The service of the company hereinafter referred to as “Empharma Pharmaceuticals”.
  • Explicit Consent: Consent relating to a specific matter, based on information and free will, given with a clarity that leaves no room for doubt and limited solely to that transaction.
  • Anonymization: Rendering personal data impossible to associate with an identified or identifiable natural person under any circumstances, even by matching them with other data.
  • Employee: Company personnel.
  • Personal Data Owner (Data Subject): The natural person whose personal data are processed.
  • Personal Data: Any information relating to an identified or identifiable natural person.
  • Special Categories of Personal Data: Data on a person’s race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, health information, fingerprints, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data.
  • Processing of Personal Data: Any operation performed on personal data, such as obtaining, recording, storing, retaining, altering, rearranging, disclosing, transferring, taking over, making available, classifying or preventing the use of such data, wholly or partly by automatic means, or by non-automatic means provided that they form part of a data filing system.
  • Data Processor: The natural or legal person who processes personal data on behalf of the data controller, based on the authority granted by the data controller.
  • Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data filing system.
  • KVK Board: The Personal Data Protection Board.
  • KVK Authority: The Personal Data Protection Authority.
  • KVKK: The Law on the Protection of Personal Data, published in the Official Gazette dated 7 April 2016 and numbered 29677.
  • Policy: The empharmailac.com Personal Data Protection and Processing Policy.
  • (Membership System): The membership system of the Company and the Company’s digital platforms.

4. Roles and Responsibilities

4.1. Board of Directors

The Board of Directors is responsible for the ultimate oversight of determining and operating the notification, review and sanction mechanisms to be applied in the event of non-compliance with the Policy, rules and regulations.

The Personal Data Protection and Processing Policy has been approved by the Board of Directors.

It is the authorized approval mechanism for ensuring that the Policy is established, implemented and, where necessary, updated.

4.2 Audit Unit

The Audit Unit is responsible for taking the measures necessary to ensure that the employees involved, as well as the companies from which external services are procured, comply with the Policy, and for examining matters in order to investigate any issues contrary to the Policy.

4.3 Information Systems Committee

The Information Systems Committee is responsible for the preparation, development, implementation and updating of this Policy. It evaluates this Policy, when necessary, in terms of whether it is up to date and what improvements it needs. Publishing the prepared document on the corporate portal is the responsibility of the Information Systems Committee Manager.

5. Legal Obligations

Our legal obligations as the data controller under the KVKK, within the scope of the protection and processing of personal data, are listed below:

As a Company, we take care to ensure that this Policy, which is open to the public, is clear, understandable and easily accessible.

5.2. Our obligation to ensure data security

As the data controller, we take the administrative and technical measures stipulated in the legislation to ensure the security of the personal data in our possession. The obligations regarding data security and the measures taken are detailed in sections 9 and 10 of this Policy.

Users have the right to terminate their membership at any stage. If the account is closed, whether by the User or by Empharma Pharmaceuticals, all licenses and other rights granted to you in these Terms of Use shall cease to be valid immediately.

Intellectual and Industrial Property Rights

All materials in the content of the site, including code and software, are protected under the legislation on Intellectual and Industrial Property Rights.

Users of empharmailac.com accept, declare and undertake that they assign, without claiming any fee, for use in Türkiye and worldwide, without any limitation as to duration or medium, in a manner that may also be assigned to others, and valid for, but not limited to, all kinds of services, media, satellite, cable and other digital, wired and wireless means within the scope of Value Added Services (cell broadcast, WAP/GPRS, mobile music, mobile video, ringback tone, Mobile TV, video streaming and all other song download services and/or new-generation mobile technologies to be developed after this date), in any medium/platform/product/material/organization etc. determined by Empharma Pharmaceuticals (radio, TV, internet, cinema, direct marketing activities, press conferences, including print and visual media, electronic or digital media such as WAP, kiosks and mobile phones, telephone exchange and IVR music, ringtones, etc.): all ownership rights over any text, photographs, videos, software, information, visual and audio materials they upload to the website and, without limitation to these, other applications and/or, where these are adapted, their adaptations and/or sound recordings and/or any arrangements and versions created and/or any fixations obtained from or connected with them (hereinafter referred to as the “Content”); their economic rights arising from authorship and from Law No. 5846 on Intellectual and Artistic Works, namely reproduction, distribution, adaptation, communication to the public by means enabling the transmission of signs, sounds and/or images, and performance; and/or their neighboring rights arising from being a performer and/or producer; their rights to determine the form, time and place of presentation to the public and to make any alteration to the work; their rights arising from designs and trademarks, to register designs and apply them to products, and all other intellectual and industrial property rights; and the personal rights of the owners of the images/sounds/content; and that they consent to the said Content being published without the need for prior permission and/or being viewed/watched by third parties to be determined by Empharma Pharmaceuticals, and to the said content and the system records relating to this content (uploading content to the system, removing it, etc.) being recorded/processed by Empharma Pharmaceuticals and shared with the companies providing infrastructure.

Users of the empharmailac.com website acknowledge and undertake that they are the full and sole owners of all ownership rights over the said content and over any element in the content constituting an Intellectual and Industrial Property right, of the economic rights of reproduction, distribution, adaptation and communication to the public by means enabling the transmission of signs, sounds and/or images, of the neighboring rights arising from being a producer and/or performer, and of the personal rights of the owners of the images/sounds/content; that they have taken over these rights, obtained permission and become the right holders from their subordinate employees, from the relevant authors or right holders or from the collecting societies to which they are affiliated, in writing and in compliance with the validity conditions set out in Articles 48 and 52 of the FSEK (Law on Intellectual and Artistic Works), without limitation and for an indefinite period without any time restriction, valid in Türkiye and throughout the world for all kinds of products/platforms/materials/organizations/media etc., including those listed above, and in a manner that may also be assigned to third parties; and that responsibility for all fees payable to Collecting Societies on account of the works rests with them; and they further acknowledge and undertake that these rights are vested in them, that they have the capacity and legal authority to assign these rights, and that no third party has, directly or indirectly, under any name or title whatsoever, any encumbrance or any financial, moral or commercial right over these rights.

These Terms of Use are governed by the laws of the Republic of Türkiye. If any provision of this agreement becomes illegal, invalid or legally unenforceable for any reason, that provision may be removed from this agreement. However, this shall not affect the validity and legal enforceability of the remaining provisions.

The Istanbul Courts and Enforcement Offices shall have jurisdiction over the resolution of any disputes that may arise from the application of the provisions and legal relationships set out above.

Information Notice and Consent Form on the Processing of Personal Data

Empharma Pharmaceuticals, as the “Data Controller”, has adopted a set of basic rules in order to protect the confidentiality of all personal data belonging to empharmailac.com users, pursuant to Law No. 6698 on the Protection of Personal Data, published in the Official Gazette dated 7 April 2016.

Protection of Personal Data: Pursuant to Law No. 6698 on the Protection of Personal Data (“KVKK”), any information that serves to make the identity of a natural person identified or identifiable falls within the scope of personal data. Your personal data held by empharmailac.com will, for the reasons, purposes and by the methods explained below, and in order to comply with the information retention, reporting and notification obligations stipulated by the relevant legal regulations and legal authorities, be recorded in our systems, stored, preserved, retained and updated by our Company in its capacity as Data Controller, and, where permitted by the legislation and within the legal limits, may be disclosed/transferred to third parties, classified and processed in the ways listed in the KVKK. By acting in accordance with these basic rules, empharmailac.com aims to protect the justified trust that the user places in the institution. For this reason, we kindly ask you to take note of the legal matters set out below.

Obligation to Inform: As the “Data Controller”, our Company is obliged to handle your Personal Data in accordance with the Law on the Protection of Personal Data. In its capacity as data controller, it will retain your personal data and your special categories of personal data; however, where permitted by the legislation, it may share them with third parties residing in Türkiye or abroad, classify them and process them in the manner specified in the Law.

Method of Collecting Personal Data: Your personal data may be collected by Empharma Pharmaceuticals in writing or electronically. We declare and undertake that, while retaining these data, we will comply with the relevant laws and the rule of good faith as set out in Article 4, paragraph 2 of the Law, and that we will keep your data accurate and, where necessary, up to date. For the avoidance of doubt, the obligation to keep data up to date set out in Article 4, paragraph 2(b) of the Law shall be limited to the extent to which empharmailac.com users notify the company of their own personal data or special categories of personal data. Empharma Pharmaceuticals is obliged to take all necessary technical and administrative measures to provide an appropriate level of security in order to prevent the unlawful processing of personal data, to prevent unlawful access to the data and to ensure the safekeeping of personal data.

Purposes and Legal Grounds for Processing Personal Data: In accordance with Article 4 of Law No. 6698 on the Protection of Personal Data and, in any event, on condition that it does not go beyond the exceptional cases specified in sub-paragraphs (a), (c) and (e) of paragraph 2 of Article 5, Empharma Pharmaceuticals asks you, the user, to share some of your personal information by saving it in the mobile application so that it can provide you with service. Empharma Pharmaceuticals stores users’ personal information only to perform certain services, to provide content and advertising on the site in line with users’ requests, and to inform them of new services. empharmailac.com users have the opportunity to change their personal information while browsing the website. This information can be changed by Empharma Pharmaceuticals where deemed necessary, and by the user at any time. Empharma Pharmaceuticals may process the data, in the manner specified in the Law, with the persons, institutions and organizations authorized by our laws and with those permitted to process information under the relevant laws.

Persons/Organizations to Which Personal Data May Be Transferred: Empharma Pharmaceuticals may transfer personal data to the institutions and organizations permitted by the legislation; these include, but are not limited to, all official authorities, as well as the customers of Empharma Pharmaceuticals under the contracts to which it is a party, its solution partners and other third parties with which it carries out commercial activities. Empharma Pharmaceuticals has the right to disclose information belonging to empharmailac.com users where the circumstances stated below so require: 1. If the User has given permission and consent for their personal information to be shared, 2. In order to determine user profiles for use within empharmailac.com and Empharma Pharmaceuticals, 3. In order to develop and supply the products and services that the User requests from empharmailac.com and Empharma Pharmaceuticals, or to resolve problems with the services and tools offered to you, 4. To the companies with which it works (cooperates) when offering products and services to the User, for use in providing these products and services, 5. During legal investigations, pursuant to a court order or where legal procedures so require.

Deletion of Personal Data: Your data retained under the Law will, if the reasons requiring their processing cease to exist, be deleted, destroyed or anonymized upon your request, under the conditions to be determined by the Regulation referred to in Article 7, paragraph 3 of the Law.

Your Rights Under Article 11 of the Law: By applying to empharmailac.com, you have the right to: a) learn whether your personal data are processed, b) request information if your personal data have been processed, c) learn the purpose of the processing of your personal data and whether they are used in accordance with that purpose, ç) know the third parties in Türkiye or abroad to whom your personal data are transferred, d) request the rectification of your personal data if they have been processed incompletely or inaccurately, e) request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law, f) request that the operations carried out pursuant to sub-paragraphs (d) and (e) above be notified to the third parties to whom your personal data have been transferred, g) object to the occurrence of a result against you through the analysis of your personal data exclusively by automated systems, and ğ) claim compensation for the damage you suffer as a result of the unlawful processing of your personal data.

In order to improve the quality of the content provided to you and to enable direct access to certain services, empharmailac.com may record and use data on your geographical location if you give your consent.

This information notice and consent form is a part of the terms of use and privacy agreement that you have accepted.

Within the framework of these explanations, I accept, declare and undertake that I consent to my personal data being collected, processed, updated, periodically checked, kept and stored in a database by Empharma Pharmaceuticals and empharmailac.com in accordance with Law No. 6698 on the Protection of Personal Data, to their being shared, where necessary, with the relevant public institutions and organizations and with third parties that are our solution partners as required by our business relationship, and to my personal data also being kept by them.

This text has been prepared to inform you about information security and to explain the rules to be followed and the responsibilities.

You are expected to provide your personal information during your visit to the empharmailac.com website. Your personal information shared by you and recorded by us is protected, and will continue to be protected, by empharmailac.com and Empharma Pharmaceuticals.

Information such as your first and last name, postal address, date of birth, gender, telephone number and email address is recorded when you provide it to empharmailac.com.

empharmailac.com has the right to disclose information belonging to users where the circumstances stated below so require:

  • If the User has given permission and consent for their personal information to be shared,
